This is the Waiver and Release Agreement ("Agreement") between Derrick Joseph, LLC (“Derrick Joseph"), and the person whose name is signed at the end of this Agreement (“Client”). ASSUMPTIONS OF RISK BY CLIENT Client warrants and acknowledges that all involvement in training activities with Derrick Joseph will be at Client's sole risk. Client warrants and acknowledges their current good health and/or their child's good health (whichever is being trained under the supervision of Derrick Joseph). Derrick Joseph will not be liable for any injury to the Client, their child, or other family member, or for any damage to the property of Client occurring while Client is training with Derrick Joseph will not be subject to any claim or demand whatsoever, including without limitation, any claim or demand for injury or damages resulting from acts of active or passive negligence on the part of Derrick Joseph, its owners, officers, agents, or employees OR the property owners of the property on which or at which Derrick Joseph is training Client. Client, for himself or herself and on behalf of the executors, administrators, assigns and successors of member, does hereby expressly forever release and discharge Derrick Joseph, its successors and assigns, as well as its officers and agents, from all such claims, demands, actions and causes of action. DAMAGES Client will be liable to Derrick Joseph for any damages to Derrick Joseph's equipment caused by Client, Client's dependent children or other family members.
